Peggy Lamb was granted unemployment benefits following her discharge from employment with the Kroger Company (Kroger). The initial decision to grant her benefits without disqualification was affirmed by an administrative hearing officer. Kroger appealed to the Board of Review, Georgia Department of Labor (Board), which held that the hearing officer applied an incorrect legal standard and reversed and remanded the case for a new decision consistent with the Board’s opinion.
