Defendant appeals from a judgment of the circuit court of Madison County sentencing him to imprisonment for a minimum of 20 and a maximum of 30 years, following a trial by jury and a verdict of guilty of the crime of murder.

The facts indicate that the defendant and some friends were drinking in a local tavern. After defendant caused a disturbance, he was forcibly ejected from the premises. He attempted to re-enter but was again ejected. The testimony varies as to whether he was beaten and thrown out, or merely escorted to the door.
