The exceptions present a single question: Should the will have been admitted to probate or an issue devisavit vel non have been awarded? See Wagner’s Estate, 289 Pa. 361. The answer depends upon whether, within the provisions of section 2 or section 3 of the Wills Act of June 7, 1917, P. L. 403, as amended, the instrument before the hearing judge was a validly signed and executed will. He decided it was not.
