MOORE, Justice.

Appellant, Ramon W. Callaway, filed suit against appellee, Loreta Elliott, his former wife, for bill of review seeking to modify a previous divorce decree with respect to the division of the community property. The trial court granted appel-lees, Loreta Elliott and husband, Kenneth C. Elliott, a summary judgment and appellant, Ramon W. Callaway, perfected this appeal.
