The plaintiff in error was convicted of the murder in the first degree of one O. W. Wilson, and sentenced to be hung.

Upon writ of error it is contended that the indictment is indefinite, uncertain and insufficient because it does not affirmatively allege that the defendant did strike the deceased. The indictment sufficiently charges that the defendant struck and killed the deceased with the weapons described. It charges that the defendant, the plaintiff in error here, did inflict several mortal wounds in and upon the head of the deceased by striking him in and upon his head with certain named…
