Plaintiff appeals as of right from the trial court’s grant of defendant’s motion for summary judgment. The litigation arose after a tragic automobile accident which took the lives of *628two young people. Plaintiff maintains that defendant’s negligent maintenance of the highway where the accident occurred caused the accident. Defendant maintains that the state was responsible for any liability arising out of the maintenance of said highway and that furthermore the county was expressly excused by statute, MCLA 250.61; MSA 9.901.
