The appellant was tried in the County Court, before the judge, on both the law and the facts, a jury being waived, on an information, wherein it is charged that he, in the county of Jack, on March 15, 1878, “ not then and there being on his own premises, or at his own place of business, did then and there unlawfully carry on his person a certain pistol, the said Jesse Leatherwood not then and there being a person authorized by law to carry said pistol, and not then and there having reasonable grounds for fearing an unlawful attack on his person, contrary,” etc.; and he was by the court…
