The indictment in this case charges- the defendant with the commission of the crime of larceny by the embezzlement of 2,791 bushels of oats, the property-of one Martin Boever, of the value of' $781.48, committed on or about April or May,. 1922. This indictment was returned.by the grand jury of Sioux County March 26, 1925.
