This case is before the court on plaintiff’s motion to dismiss the petition of the defendant to establish the truth of its exceptions and the correctness of the transcript of evidence.

This is an action of trespass on the case for negligence. It appears from the papers in the case certified to this court that it was tried before Mr. Justice Stearns and a jury on the 30th and 31st days of October, 1916, and that a verdict was rendered for the plaintiff in the sum of $5,000: The defendant filed a motion for a new trial, which was heard and denied.
