— In an action to recover damages for breach of contract, the third-party defendant William Floyd Union Free School District appeals from so much of an order of the Supreme Court, Suffolk County (Brown, J.), entered June 29, 1990, as denied its motion to dismiss the third-party complaint insofar as it is asserted against it and the affirmative defenses and cross claims of the plaintiff and third-party defendant Lawrence L. Smith.
Ordered that the order is modified, on the law, by deleting the provision thereof denying those branches of the motion which were to dismiss the "second affirmative…
