On January 11,1935, appellee, C. C. Leftwich filed his complaint at law in the Logan Circuit Court against J. D. Leftwich, Coates & Raines, Inc., and the Fireman’s Fund Insurance Company, and on the same day he also filed a similar action against J. D. Leftwich, Coates .& Raines, Inc., and the Great American Insurance Company.
