In an action by a former Judge of the Family Court, Nassau County, to recover an unpaid portion of his judicial salary allegedly due and owing, (1) defendants appeal from an order of the Supreme Court, Nassau County, entered April 24, 1979, which granted plaintiff’s motion for summary judgment and (2) plaintiff cross-appeals from so much of the same order as failed to award interest. Order modified, on the law, by adding thereto a provision granting interest to the plaintiff from August 31, 1976. As so modified, order affirmed, without costs or disbursements.
