This is an action of tort for personal injuries, received by the plaintiff and alleged to have been caused by the negligence of the defendant. The case was tried before a jury. At the close of the plaintiff’s evidence, the defendant rested and duly made a motion for a directed verdict in its favor. The motion was denied and the defendant duly excepted. The evidence was then submitted to the jury and a verdict was returned in favor of the plaintiff.
