Appeal from circuit court of Lauderdale county. Hon. C. C. Miller, Judge. • Percy Thompson Avas convicted of an assault with intent to ravish, and he appeals. This appellant has assigned as error the refusal of court to grant him a peremptory instruction. This assignment I submit is well taken in the 'light of this record. The appellant should have been indicted, tried and convicted on a charge of trespass and not the charge preferred.

The appellant was indicted and convicted of an assault upon an Assyrian girl., a female of previous chaste character, with'the willful and felonious intention to. ravish and carnally know the said female, and was convicted and sentenced to the pen for the term of his natural life, from Avliich sentence this appeal is prosecuted.'
