This is a congressional reference arising from the relationship between the United States Government and the Menominee Indian Tribe. It was referred to the court in 1993. The dispute it embodies has been the subject of prior litigation in our predecessor courts. That litigation, involving claims by the Menominee Indian Tribe of Wisconsin (“Tribe” or “Menominee” or “plaintiff’) on substantially the same facts and claims at issue herein, was decided against the Tribe.
