—In an action to recover damages for personal injuries, etc., the plaintiffs appeal, as limited by their brief, from so much of an order of the Supreme Court, Queens County (Milano, J.), dated July 13, 2001, as granted those branches of the motion of the defendant Home Federal Savings Bank, and the separate motion of the defendants Jules Rabin and Sherwood Newman, individually and doing business as S&S Realty Co., which were for summary judgment dismissing the complaint insofar as asserted against them.

Ordered that the order is affirmed insofar as appealed from, with one bill of costs payable…
