Steven Thomas Rodgers was convicted after a jury trial on a two-count indictment. Count I alleged unlawful distribution on February 17, 1981, of cocaine in violation of 21 U.S.C. § 841(a)(1); Count II alleged unlawful possession with intent to distribute, on October 6, 1982, of cocaine in violation of 21 U.S.C. § 841(a)(1). On appeal, Rodgers challenges this conviction on three grounds.
