1Opinion of the CourtCobb, J.

An accusation brought in the city court of Griffin charged that Fambrough, the accused, procured from Sears certain articles of merchandise hy falsely representing to him that another person had promised to pay for the goods. The proof showed that-Sears furnished the goods to the accused upon his representation that the person referred to had promised that he would “ stand security ” for the goods. The accused was convicted, and his motion for a new trial, based on the general grounds only, having been overruled, he excepted.
