The Department of Transportation, Bureau of Driver Licensing (Department), appeals from an order of the Court of Common Pleas of Luzerne County (common pleas) that sustained the statutory appeal of Joseph Tullo and reversed the Department’s one-year suspension of Tul- lo’s operating privileges for refusal to submit to a chemical test. 1
