This case came on for hearing on the motion for a new trial on the ground of newly discovered evidence, supported by affidavit of the defendant, Elwood M. Williams and that of his attorney, Vernon Stiver, and at which time and before the actual submission of testimony, the plaintiff, through *157her attorney, filed a motion to suppress the evidence on the grounds it was obtained through theft and therefore, not eligible to be submitted into evidence.
