This suit involves a petition for a writ of habeas corpus by respondent to effect the return of Pete E. F. Burns, Jr., to the state of California. This appeal is taken from a judgment granting the writ.

The petition alleges that respondent and his minor son are residents of the city of Los Angeles, California, that respondent and Sarah Fitzhugh Burns Dawson were legally divorced by the superior court of the state of California, an interlocutory order of divorce having been granted and filed therein on January 6, 1930, and that a final judgment of divorce was granted and filed January 12, 1931;…
