Ordered that the final judgment, insofar as appealed from, is affirmed, without costs.

Insofar as is relevant to the issues raised on appeal, tenant defended this commercial nonpayment summary proceeding, which was premised on tenant’s failure to pay rent and additional rent for January 2013, on the ground that it had been constructively evicted from the subject premises.
