MEMORANDUM OPINION

I. INTRODUCTION
Petitioner Vicky Chao (“petitioner”) is a Delaware inmate in custody at the Delores J. Baylor Women’s Correctional Institution *586in New Castle, Delaware. Presently before the court is petitioner’s application for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 (D.I. 1), and the State’s motion to dismiss the application for lack of subject matter jurisdiction (D.I. 13). For the reasons that follow, the court will grant the State’s motion to dismiss petitioner’s application.
