On March 18, 1968, the appellant was indicted in the United States District Court for the Western District of North Carolina for the offenses of conspiracy to transport stolen property across state lines and transporting stolen property across state lines. He plead guilty on November 25, 1968, and was sentenced to 3 years in prison which sentence was suspended on probation and payment of a fine. *779On-: March 4, 1968, the grand jury of Whitfield" County, Georgia, indicted him for the offense of larceny arising out of the .same transaction.
