Plaintiff brought this action to recover for injuries sustained when she tripped and fell on a stairway located in a common area of the apartment complex where she resides. She claimed that the stairs were in a dangerously unsafe condition, 1 both in violation of Oregon’s Residential Landlord Tenant Act (RLTA), ORS 90.100 et seq, and as a result of negligence.
