This is an action for damages, alleged to have been sustained by plaintiff, through the negligence and wilfulness of the defendant, in failing to stop its train at the flag station, to which it sold him a ticket; also, for the alleged violation of sections 2134 and 2202 of the Code of Laws. The jury rendered a verdict in favor of the plaintiff for $250. The defendant appealed and the first assignment of error is as follows:
