— Appeal by the People from an order of the Supreme Court, Queens County (Eng, J.), dated March 14, 1991, which granted the defendant’s motion to set aside a jury verdict rendered November 2, 1990, finding him guilty of criminal sale of a controlled substance in the third degree.

Ordered that the order is affirmed.

We find that the trial court properly granted the defendant’s motion to set aside the verdict on the ground that the prosecutor’s misconduct deprived him of a fair trial (see, CPL 330.30 [1]; People v Clausell, 182 AD2d 132; cf., People v Rodriguez, 174 AD2d 763). The defendant and a…
