BACKGROUND:

On April 28, 1999, plaintiffs John and Mary Doe commenced this action against various- defendants 1 with the filing of a complaint pursuant to the Americans with Disabilities Act -(“ADA”), 42 U.S.C. § 12101, et seq.; section 504 of the Rehabilitation Act of 1973 (“Rehab Act”), 29 U.S.C. § 794; Title IV of the Civil Rights Act of 1964 (“Title IV”); and 42 U.S.C. § 1983.
