Appellee has filed a motion for a- rehearing which we have concluded should be granted. The original opinion will be set aside and the following opinion delivered and filed as the opinion of the court:

Appellee, Christopher Lee McGinnis, instituted this suit against appellant, Texas & New Orleans Railroad Company, seeking to recover damages for personal injuries alleged to have been sustained by him while in the employ of the appellant as a switch-man.
