Mr. Presiding Justice Baldwin

delivered the opinion of the court..This is an action brought in the Circuit Court of Cook county to recover for the death of plaintiff’s intestate, as a result of injuries received through the alleged negligence of appellant, on its premises February 2, 1909. A jury trial resulted in a verdict, and judgment against appellant for $1,768.

The plant of the appellant consisted of a malt house on the east side of which there were two switch tracks extending north and south just outside of the building. There was a door on the east side of the malt house and a person…
