Grandville E. Peters, administrator of the estate of Douglas Lee Peters, deceased, instituted this proceeding against William (Bill) Brown, administrator of the estate of John Brown, deceased, and Ernest William Ayers by motion for judgment to recover damages for the death of his decedent, resulting from the collision of an automobile operated by John Brown with an automobile operated by Ayers, in which Douglas Lee Peters was a passenger. Plaintiff alleged that the death of his decedent was due to the gross negligence of Ayers and to the concurrent contributing negligence of John Brown.
