Mary Katherine Menard, as curator of the interdict, Allen R. Menard, and as natural tutrix of the minor children, Allen R. Menard, Jr. and Keith Scott Menard, instituted this action seeking worker’s compensation benefits, penalties and attorney’s fees from the defendant, The Military Department, The State of Louisiana, Louisiana Army & Air National Guard (State). Plaintiff alleged that her husband, Allen, was seriously and permanently injured while in the course and scope of his employment with the Louisiana National Guard.
