MAJOR, Chief Judge.
These are appeals from a decree entered June 1, 1948, dismissing sua sponte a bankruptcy proceeding. The appeals are by Horace A. Young, trustee in- bankruptcy, the Benevolent and Protective Order of Elks, an asserted creditor (herein*161after referred to as the Elks), and Armin F. Hillmer, as representative of all creditors of the Chicago Bank of Commerce.
