This is an action on a promissory note, commenced in the district court of Atoka county by the Oklahoma State Bank as plaintiff, against J. E. Ward, defendant. The parties will be referred to as they appeared in the trial court. The note in question was exe cuted on June 20, 1910, payable to the order of the Farmers’ State Bank of Tushka, on demand, and bore a notation showing payment of interest thereon to January 15, 1911. The Bank Commissioner took possession of the Farmers’ State Bank of Tushka, and sold said note, together with other of its assets, to the plaintiff…
