Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered February 15, 2008, upon a verdict convicting defendant of the crime of rape in the second degree.
In December 2006, defendant, who was then 26 years old, engaged in sexual relations with the victim (born in 1992). Several weeks later, the victim informed other adults, including her father, of the rape, and her father took her to the police department to report it.
