ISSUE

This court is asked to decide whether a new amendment to subdivision a of section 55 of the New York City Rent and Eviction Regulations (L 1984, ch 234) also known as section Y51-6.0 (subd b, par [1]) of the Administrative Code of the City of New York, which denies a landlord the right to seek and recover in good faith possession of a housing accommodation for his personal use and occupancy or for the use and occupancy of his immediate family (where the tenant is 62 years of age or older, has been a tenant in a housing accommodation in that building…
