RAMSEY, Judge.

Appellant was charged by indictment in the District Court of Travis County with the offense of theft of a certain diamond ring of the value of one hundred dollars, the property of Anna Koch, having obtained possession of said diamond ring from said Anna Koch by virtue of his contract of borrowing. He was convicted of this charge on the 12th of November, 1908, and his punishment assessed at confinement in the penitentiary for a period of two years. From this conviction this appeal results.
