GOODRICH, Circuit Judge.

Appellant, plaintiff below, was the successful bidder upon a road construction contract let by the defendant County. The primary purpose of the work was to reduce the degree of curvature along a certain section of highway in Harrison Township, Allegheny County. The relocation of the highway required a change in the channels of Bull Creek and Little Bull Creek and the construction of a new bridge over Little Bull Creek.
