At issue is whether secured creditors Kostas Chelios and Susan Chelios (“the Chelios’ ”) are entitled to compensation for attorneys’ fees and costs pursuant to § 506(b) or § 503(b)(3)(D) of the Bankruptcy Code. The Chelios’ contend that (1) because the underlying unsecured agreement which lead to their receiving a judgment and ultimately a judgment lien against property of the debtor contained a provision providing for attorneys’ fees, they are entitled to attorneys’ fees to the extent they are secured pursuant to 11 U.S.C. §…
