This appeal arises from proceedings had in an action to partition real estate.
In the petition, which contained six causes of action, it was alleged that Joe Goltl, known also as Joseph Goltl, died intestate on December 19, 1933, owning certain described real estate consisting of 360 acres of farm land and two lots in the city of Herndon, all in Rawlins county, Kansas; that he left as his only heirs, his wife, Susie Goltl, defendant, and his children, Louise Goltl Bigler, Ida Goltl Kendrick, Lydia Goltl Springer, the plaintiffs, and Henry…
