This declaratory judgment action concerns a liability insurer’s duty to provide its insured with a defense in a tort suit brought against the insured.

During the time period relevant to this case, the Sun Life Insurance Company of America was a named insured in a liability insurance policy issued by the petitioner, St. Paul Fire & Marine Insurance Company.
