Appellee, the city of Houston, instituted this proceeding to condemn a strip of land 40 feet wide and 70 feet long for street purposes across the right of way of appellant Houston & Texas Central Railway Company.
Houston Heights, an addition to appellee, is bounded on the south by appellant’s right of way. Heretofore there has been but one thoroughfare, Heights boulevard,• to the city proper, by way of Washington avenue. Yale street in Houston Heights runs parallel with ■Heights boulevard, but heretofore has not extended as far south as appellant’s right of •way; and appellee sought to open…
