The appellant was indicted for two counts of sale of marijuana, one allegedly occurring on January 21, 1983, the other on January 28, 1983. Based on the appellant’s contention that a lengthy pre-indictment delay hampered his ability to develop an alibi defense and left him with no defense other than that of mistaken identity, the trial court ordered the state to disclose the identity of a confidential informant who had allegedly witnessed the January 21st incident.
