POPE, District Judge.

The present review involves a decision upon the validity of a mortgage held) by the Dexter State Bank against Plarnden. The facts are that on December 9, 1910, Harnden borrowed from the bank $600, secured by a chattel mortgage upon 'his stock, which was never recorded. On March 8, 1911, the bank made a further loan, arid a new note was given for the old loan of $600 and the new loan, aggregating $950, which note was made payable in 30 clays and was secured by a new chattel mortgage.
