Appeal, by permission, from an order of the *1396County Court of Ulster County (McGinty, J.), entered February 19, 2015, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment convicting him of the crime of murder in the second degree, after a hearing.
After a jury trial, defendant was convicted of murder in the second degree for killing his estranged wife. On defendant’s direct appeal, we affirmed the judgment of conviction (289 AD2d 692 [2001]).
