COOPER, Justice.

Appellant, Dominico Ramon Burdell, was convicted in the Fayette Circuit Court of trafficking in a controlled substance in the first degree, KRS 218A.1412, tampering with physical evidence, KRS 524.100, possession of drug paraphernalia, KRS 218A.500, and persistent felony offender in the first degree, KRS 532.080(3). He was sentenced to ten years imprisonment on the trafficking conviction, to five years on the tampering conviction, and to twelve months and a $500.00 fine on the drug paraphernalia conviction.
