Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

Acting upon confidential information, a correction officer searched petitioner’s cell, recovered his state-issued jacket and *1083discovered a substance that tested positive for marihuana, as well as matches and rolling papers, secreted in the lining.
