Appeal by the plaintiff, Hay Augusta Lenz, an infant, by Robert L. Hiles, her guardian ad litem, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Kings on the 3d day of Harch, 1896, upon the dismissal of the complaint directed by the court after a trial before the court and a jury.

By this action damages are sought to be recovered for personal injuries inflicted upon plaintiff by the falling of a pole standing upon defendant’s premises. The plaintiff, at the time of the reception of the injury, was between nine and ten years of age, and resided with her parents in an apartment house owned by defendant, known as Ho. 6 Ocean place in the city of Brooklyn.
