Action by appellee against appellant to recover damages for personal injuries sustained in an automobile accident. Verdict for $3,000.00, motion for new trial overruled, and error assigned in the overruling thereof.

The evidence is sharply conflicting. That most favorable to the appellee discloses that he was standing on the northwest corner of the intersection of Main Street and Broadway in the business district of Princeton, Indiana, in the daytime.
