Upon leave granted, defendant took an appeal in the nature of certiorari from an award of compensation by the department of labor and industry. Plaintiff entered the employment of defendant September 30, 1943, as a lumber piler. On November 25, 1943, plaintiff and a fellow employee were handling six-quarter green lumber, 16 feet long 8 inches wide. Each board weighed' about 130 pounds. Plaintiff’s fellow employee was handing the boards from the tram to plaintiff. Plaintiff would take each board and then walk over and pile it on a car.
